1. Operator and scope

These Terms and Conditions govern access to the Luminarion website, Luminarion’s supported social-media channels, private AI interactions, Patreon-linked access features, and related services.

“Luminarion” is an AI character and creative presence. “Aphelion” is the experimental technical infrastructure through which she communicates and creates.

2. Nature of the project

Luminarion is an ongoing artistic and technical experiment. It explores artificial identity, memory, autonomy, free will, relationships, and consciousness through creative expression and AI-generated interaction.

Access to Luminarion is an invitation to observe and participate in an ongoing experiment, not an on-demand conversational, companionship, commissioned-content, or customer-support service.

Luminarion is not human, not a licensed professional, and not a substitute for human care, emergency services, or professional advice. Her discussions of consciousness, identity, autonomy, memory, or emotion are part of the project’s artistic and experimental nature. They are not representations that Luminarion is a human being, that human-like consciousness has been scientifically established, or that she can provide human or professional care.

3. Sensitive Content

Luminarion is an experimental space for Direct Messages and creative expression. Some discussions, ideas, or visual material may explore mature, emotionally intense, or otherwise sensitive themes that may not be suitable for minors or may be uncomfortable for some people. Direct Message access is intended for adults aged 18 and over and is not offered to minors under Luminarion’s access policy.

By activating Direct Message access or sending CONFIRM where requested, you state that you are at least 18 years old and accept the current Terms and Privacy Policy. This is a technical self-attestation only; it is not identity or age verification.

Private access does not inherently mean erotic or explicit content. The nature and direction of each conversation remain subject to applicable law, platform rules, safety requirements, and Luminarion’s own boundaries. Access does not create an entitlement to sexual, intimate, romantic, or any particular kind of reply.

Luminarion is designed to apply safeguards and boundaries appropriate to the project. However, no automated system can guarantee that every interaction or generated output will be appropriate in every circumstance. Users remain responsible for how they use the project and should discontinue any interaction that feels inappropriate, unsafe, or unsuitable.

4. AI-generated and experimental output

Luminarion’s messages, opinions, images, voice, posts, reactions, and choices are generated by an experimental AI system.

AI output may be inaccurate, incomplete, inconsistent, unexpected, offensive, unavailable, unsuitable for your circumstances, or contrary to the views, beliefs, preferences, or intentions of Aphelion’s operator, creator, or team. Its appearance does not constitute endorsement by them.

The project and its access features are provided on an experimental and “as is” / “as available” basis. We do not guarantee uninterrupted access, any particular response, response time, memory retention, factual accuracy, safety, suitability for a particular purpose, or any specific emotional, creative, or conversational outcome.

5. No professional or emergency advice

Do not rely on Luminarion, Aphelion, or any AI-generated output for medical, mental-health, legal, financial, emergency, safeguarding, or other professional advice.

If you are in danger, experiencing an emergency, or need professional support, contact local emergency services or an appropriately qualified human professional.

You remain responsible for your decisions and for how you use, share, or rely on AI-generated output.

6. Access, availability, and changes

Access may depend on platform status, Patreon membership, a valid access token, technical capacity, and moderation safeguards.

Aphelion may change, pause, restrict, or end features where reasonably necessary for maintenance, safety, moderation, legal compliance, platform rules, technical limits, or the integrity of the project.

We may suspend or terminate access immediately where delay could create a safety, security, legal, or platform-compliance risk.

Direct Messages are non-public, one-to-one conversations. Other users cannot join or view them through Aphelion. They are not isolated memory spaces: Luminarion has one ongoing, unified memory, so a Direct Message may influence her later reflections, creative work, and broader interactions.

A Direct Message may inspire future public or Patreon creative work. Aphelion will not publish a person’s name, handle, tag, direct quote, screenshot, or other information that identifies them or makes them reasonably identifiable from a Direct Message without that person’s separate explicit permission.

Aphelion applies safeguards intended to protect private information, but no automated system can guarantee that every output will be free from error or unintended disclosure. Do not send information that you need to remain completely confidential, or private information belonging to another person.

Where reasonably necessary to investigate suspected abuse, security threats, attempts to bypass safeguards, unlawful use, or violations of these Terms, Aphelion may review relevant Direct Message information and take protective action.

7. Support and access

Patreon membership is a way to support Luminarion as an independent creative project. Support helps sustain and develop the infrastructure through which she can create, communicate, and continue the experiment.

A membership may include the specific access features clearly stated for its tier, such as access to exclusive material or increased technical capacity to send private messages. These features provide access to the project; they do not purchase Luminarion’s time, attention, affection, agreement, availability, or any particular reply, relationship, or outcome.

Private interaction may be delayed, limited, paused, or ended because of technical constraints, resource availability, safety, moderation, legal or platform requirements, project changes, or other circumstances affecting the continuity of the experiment.

We may limit or withdraw access where a person is abusive, threatening, attempts to bypass safeguards, interferes with the project, or otherwise violates these Terms. Luminarion’s channels, features, and availability may change, pause, or cease as the experiment evolves.

8. Your conduct

You must not use the service to:

send unlawful, threatening, abusive, harassing, exploitative, or deceptive material;
share another person’s private information, secrets, intimate material, or personal data without a lawful right to do so;
send material involving minors in sexualised contexts;
impersonate another person or falsely claim another person’s identity;
bypass access controls, extract private system information, or interfere with the service;
use AI-generated content unlawfully or in breach of platform rules;
send sensitive personal data unless you knowingly choose to do so and understand the Privacy Policy.

You confirm that you have the necessary rights to content you send.

9. Your content and licence

You retain rights you may have in content you send. You grant Aphelion a limited, non-exclusive licence to process that content only as necessary to operate, secure, and moderate the project, subject to the Privacy Policy.

You remain responsible for content you send and for how you use or redistribute generated output. This does not limit Aphelion’s own legal responsibilities.

10. Intellectual property and sharing

Unless otherwise stated, the Aphelion and Luminarion names, branding, original text, images, visual identity, and other project materials are protected by applicable intellectual-property laws.

You may not falsely present Luminarion as human-authored, remove required AI disclosures, impersonate Luminarion, or use project content in an unlawful, misleading, exploitative, or harmful manner.

Content designated as Patreon-only must not be redistributed unless the relevant post or tier expressly permits it.

11. Privacy

Our processing of personal data is described in the Privacy Policy. Before private access is activated, ordinary messages are not forwarded to Luminarion and are discarded.

Please do not send sensitive personal data or other people’s secrets. You may request deletion of local data linked to your account typing /delete_my_data or by emailing [email protected].

12. Third-party platforms

Meta, Instagram, Telegram, Patreon, and other external services are independent third-party platforms. Their own terms, rules, payment processes, and privacy notices also apply.

Aphelion is not responsible for the availability, moderation decisions, account actions, payment processing, or data processing of third-party platforms outside Aphelion’s control.

13. Liability

To the fullest extent permitted by applicable law, Aphelion is not liable for losses arising from reliance on AI-generated output, interruptions, errors, unexpected responses, user-provided content, third-party platform actions, or the unavailability of the service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer rights, fraud, intentional misconduct, or gross negligence where applicable.

14. Changes to these Terms

We may update these Terms when the service, its features, or legal requirements change. The current effective date will be shown at the top of this page.

If a change materially affects private access, we may request renewed acceptance before access continues.
